2. Global Scope and Eligibility

  • International Shipping: We sell and ship products worldwide. By placing an order, you confirm that you have the legal capacity to enter into binding contracts and that importing the ordered items does not violate any local laws or regulations in your country of residence.
  • Language: These terms are provided in English for international accessibility, but their legal interpretation aligns with European Union e-commerce regulations.

3. Pricing, Currency, and Payments

  • Currency: All prices are displayed in [Euros (€) or US Dollars ($)]. Prices include VAT at the legal rate applicable in Portugal (if and when applicable) but exclude shipping costs.
  • Customs, Duties, and Taxes: For orders shipped outside the European Union, the customer is solely responsible for paying any import duties, customs fees, or local taxes levied by the destination country.
  • Payment Methods: We accept the payment methods displayed at the checkout (e.g., Credit Card, PayPal, etc.). Orders will only be processed once payment confirmation is received.

4. Shipping and Delivery

  • Processing Times: Orders are processed within an average of [X] business days after payment confirmation.
  • Delivery Times: Shipping times vary depending on the destination country and the selected carrier. TI·ART·UR  is not liable for delays caused by customs clearance processes, postal strikes, or force majeure events.
  • Lost Packages: If a package is officially declared lost by the carrier, we will either reship the items or issue a full refund.

5. Right of Withdrawal and Returns (EU Customers)

  • 14-Day Cooling-Off Period: In accordance with European Union consumer protection laws, customers residing within the EU have the right to withdraw from the contract and return the product within 14 calendar days of receiving it, without giving any reason.
  • Conditions: The product must be returned in its original packaging, unused, unaltered, and undamaged.
  • Return Shipping Costs: Unless stated otherwise, the customer is responsible for paying the direct costs of returning the items.
  • Exceptions: We do not accept returns for personalized/custom-made items, sealed hygiene products that have been unsealed after delivery, or downloadable digital products.

6. Warranties and Compliance

Consumer goods sold to private individuals within the European Union are covered by a legal conformity warranty against manufacturing defects under EU law. For customers outside the EU, our warranty is limited to manufacturing defects reported within 30  days of delivery.

7. Limitation of Liability and User Accounts

  • WooCommerce Accounts: If you create an account on our store, you are entirely responsible for maintaining the confidentiality of your login credentials.
  • Inventory Errors: In the event of a technical glitch or sudden stock shortage that prevents us from fulfilling an item you have already paid for, you will be refunded in full. TI·ART·UR shall not be liable for any additional compensation.

8. Governing Law and Dispute Resolution

  • Governing Law: These Terms and Conditions are governed by and construed in accordance with Portuguese and European Union law.
  • Alternative Dispute Resolution (ADR): EU consumers can resolve disputes through the European Commission’s Online Dispute Resolution (ODR) platform or via Consumer Arbitration Centers in Portugal.
